PROCUREMENT: Tele2 Accuses Government of Unfair and Discriminatory Public Procurement

The mobile phone operator Tele 2 claims that it has been irrationally and unlawfully excluded from a public procurement procedure, regarding the provision of telecommunication services and acquisition of cell phones to the government. The potential deal is valued at €5.3 million.

Tele2 and cell phone vendors are indignant because they claim that the Croatian government wrote the public tender in order to receive acceptable bids only from Croatian Telekom and Vipnet. In particular, Tele2 argues that its method of billing and the fact that it provides its services using 3G technology, and not 4G, are not adequate reasons to be excluded from the bidding process…
