Procurement Procedure in Cases of Unavailability of Electronic Public Procurement System

Economy Minister Tomislav Panenic (Bridge of Independent Lists (MOST)) issued the Instructions on the Public Procurement Procedure in Cases of Unavailability of the Electronic Public Procurement Classifieds (EOJN) System. This is a technical decision, however it is very important, since every public procurement tender has to be published on-line via the EOJN system, enabling the potential bidders to access the procurement documents. Additionally, the normally operating EOJN system is important, since there is an obligation of bidders to submit their proposals exclusively electronically in the procurement procedures of great value since 1 January 2016, and in all other procurement procedures since 1 July 2016. The Instructions prescribe how to manage the situation when the EOJN system becomes inaccessible, due to technical difficulties. In such cases, the state-owned Official Gazette (i.e. Narodne Novine), which manages the system, is obliged to notify the bidders of the existing difficulties via e-mail, and the Central Procurement Office, publishing the notification on the Official Gazette web-site. The Official Gazette is also obliged to keep the records of such cases, notifying the Central Procurement Office on frequency and number of such cases.
